Two doctors seek to have Kansas change abortion rules
Two physicians who sued over new state regulations targeting abortion providers are ready to ask Kansas health officials to scrap the requirements, which they argue are “medically unnecessary” and designed to put operations like theirs out of business. A meeting has been scheduled for today (Wednesday).
Herbert Hodes and his daughter, Traci Nauser, a fellow suburban Kansas City doctor, submitted a statement ahead of a public hearing by the Kansas Department of Health and Environment. They’re asking the agency to scrap regulations that tell providers what drugs and equipment they must stock and set minimum temperature and sizes for procedure and recovery rooms.
Hodes and Nauser had filed a federal lawsuit against the rules in June, just before the health department said their Center for Women’s Health in Overland Park would not be licensed to continue performing abortions. A federal judge blocked enforcement of the rules, allowing the Center to operate.
The health department decided not to hold a public hearing and consideration of changes to get the rules in place quickly, but unless the department goes through that process, the regulations will expire on Oct. 29.
